Terms and Conditions
1. Scope of Application
These Terms and Conditions apply to all orders placed through our online shop by consumers and business customers.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or self-employed professional activity. A business customer is a natural or legal person, or a partnership with legal capacity, who, when entering into a legal transaction, acts in the exercise of their trade, business or self-employed professional activity.
The following applies to business customers: If the business customer uses conflicting or supplementary general terms and conditions, their applicability is hereby rejected. They shall only become part of the contract if we have expressly agreed to them.
2. Contractual Partner and Conclusion of Contract
The purchase contract is concluded with KONSTANDIN GmbH.
By listing products in the online shop, we make a binding offer to enter into a contract for those items. You may initially place our products in the shopping basket without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained during the ordering process.
The contract is concluded when you accept the offer for the goods contained in the shopping basket by clicking the order button. Immediately after submitting your order, you will receive confirmation by email.
3. Contract Language and Storage of Contract Text
The language available for concluding the contract is German.
We store the contract text and send you the order details and these Terms and Conditions in text form. You can view the contract text in your customer account.
4. Delivery Conditions
Shipping costs will be added to the stated product prices. Details of the applicable shipping costs are provided with the respective offers.
We deliver goods by shipment only. Unfortunately, collection in person is not possible.
We do not deliver to Packstations.
5. Payment
The following payment methods are generally available in our online shop:
PayPal Plus
As part of the PayPal Plus payment service, we offer you various payment methods as PayPal services. You will be redirected to the website of the online provider PayPal. There, you can enter your payment details, confirm PayPal’s use of your data and authorise payment to PayPal.
If you choose PayPal as your payment method, you must be registered with PayPal or register first and authenticate yourself using your login details in order to pay the invoice amount. The payment transaction is carried out automatically by PayPal immediately after you confirm the payment instruction. Further information is provided during the ordering process.
Credit Card via PayPal
If you choose payment by credit card, you do not need to be registered with PayPal in order to pay the invoice amount. The payment transaction will be initiated by PayPal immediately after you confirm the payment instruction and authenticate yourself as the legitimate cardholder. Your credit card provider will then process the payment and charge your card. Further information is provided during the ordering process.
Direct Debit via PayPal
If you choose payment by direct debit, you do not need to be registered with PayPal in order to pay the invoice amount. By confirming the payment instruction, you grant PayPal a direct debit mandate. PayPal will inform you of the date on which your account will be debited (so-called pre-notification). Upon submission of the direct debit mandate immediately after confirmation of the payment instruction, PayPal will instruct its bank to initiate the payment transaction. The payment transaction will then be carried out and your account will be debited. Further information is provided during the ordering process.
6. Right of Withdrawal
Consumers are entitled to the statutory right of withdrawal, as described in the withdrawal policy.
Business customers are not granted a voluntary right of withdrawal.
7. Retention of Title
The goods remain our property until payment has been made in full.
The following additionally applies to business customers: We retain title to the goods until all claims arising from an ongoing business relationship have been settled in full. You may resell goods subject to retention of title in the ordinary course of business. You hereby assign to us in advance all claims arising from such resale, irrespective of whether the reserved goods have been combined or mixed with a new item, up to the amount of the invoice total, and we accept this assignment. You remain authorised to collect the claims; however, we may also collect the claims ourselves if you fail to meet your payment obligations.
